Contact forms

The information collected in any email subscription form will be collected and used only for the newsletter subscription that the user has subscribed for. If the user changes their mind they will be able to unsubscribe buy clicking on the ‘unsubscribe’ link at the bottom of the page. The information collected will not be supplied to any third parties.

General Promotion Terms & Conditions

These General Promotion Terms & Conditions apply to promotions, discounts, special offers, vouchers and other promotional campaigns offered by Live Strong Physiotherapy (“Live Strong”, “we”, “our” or “us”), unless otherwise stated in the specific terms of a promotion.

Promotion-Specific Terms

Individual promotions may have additional terms and conditions, including eligibility requirements, promotional periods, participating services, discount amounts or redemption requirements.

Where promotion-specific terms are provided, those terms apply in addition to these General Promotion Terms & Conditions. If there is any inconsistency, the promotion-specific terms will apply to the extent of that inconsistency.

Eligibility

Unless otherwise stated, promotions are available to eligible patients of Live Strong Physiotherapy who meet the conditions stated in the relevant promotion.

Promotions may be limited to:

new patients;
existing patients;
particular services or appointment types;
particular practitioners;
particular clinic locations;
appointments booked during a specified promotional period; or
patients who book using a specified booking link, promotional code or other redemption method.

Live Strong reserves the right to verify eligibility before applying a promotional offer.

Promotional Period

Promotions are only available during the period stated in the relevant advertisement or offer.

Where an offer requires an appointment to be booked during a promotional period, the appointment itself may occur after the promotional period unless otherwise stated.

Promotions cannot generally be applied retrospectively to appointments that were booked, provided or paid for before the promotion was redeemed.

Redemption

Patients must follow the redemption instructions provided with the relevant promotion.

This may include using a promotional booking link, entering a promotional code, presenting an offer, or advising Live Strong staff of the promotion at the time of booking.

Unless otherwise stated, a promotion may only be redeemed once per eligible patient.

Discounts

Where a promotion provides a percentage or dollar-value discount, the discount applies only to the service or appointment specified in the promotion.

Unless otherwise stated:

promotions cannot be combined with another Live Strong promotional offer, discount or voucher;
promotions cannot be exchanged for cash or credit;
any unused portion of a promotional discount has no cash value; and
discounts cannot be transferred to another person.

Where an advertised discount refers to a usual or standard price, the discount will be calculated against the applicable standard fee for that service at the time the promotion is offered.

Third-Party Funded Services

Unless specifically stated otherwise, promotions are intended for privately paying patients.

Promotions may not apply to services funded, reimbursed or paid for by a third party, including, where applicable:

WorkCover or workers’ compensation insurers;
compulsory third-party insurers;
the Department of Veterans’ Affairs;
Medicare-funded services;
NDIS-funded services;
home-care or aged-care funding arrangements;
employers; or
other insurers or funding organisations.

Live Strong may decline to apply a promotion where doing so would conflict with the requirements, fee schedules or conditions of a third-party funding arrangement.

Private Health Insurance

Where private health insurance is used, any rebate is determined by the patient’s health insurer and individual level of cover.

Any private health insurance claim will reflect the fee actually charged for the service where required.

Live Strong does not guarantee the amount of any private health insurance rebate. Patients should contact their health insurer if they wish to confirm their expected rebate or out-of-pocket cost.

Clinical Appropriateness

Promotional offers do not guarantee that a particular treatment, service or number of appointments will be clinically appropriate for an individual patient.

All assessment and treatment recommendations are based on the treating practitioner’s professional clinical judgement and the individual patient’s circumstances.

Patients are under no obligation to undertake additional treatment because they have accessed a promotional offer.

Bookings, Cancellations and Non-Attendance

Appointments booked using a promotion remain subject to Live Strong Physiotherapy’s normal booking, cancellation and non-attendance policies.

Where applicable, cancellation or non-attendance fees may be calculated using the clinic’s usual appointment fee rather than the promotional price if this has been disclosed as part of the applicable promotion or booking conditions.

Appointment Availability

All promotional appointments are subject to practitioner and appointment availability.

A promotion does not guarantee availability with a particular practitioner or at a particular appointment time unless expressly stated.

Errors

Live Strong takes reasonable steps to ensure promotional information is accurate.

If a promotion contains an obvious administrative, typographical or pricing error, Live Strong may correct the error and will communicate the correction as soon as reasonably practicable.

Nothing in this clause limits any rights a patient may have under applicable consumer law.

Changes or Withdrawal of Promotions

Live Strong may modify, suspend or withdraw a promotion where reasonably necessary, including because of an administrative error, circumstances outside our reasonable control or changes to service availability.

Where a patient has already validly redeemed or purchased an offer, Live Strong will honour the offer where required by law or provide an appropriate alternative or remedy.

Promotions will not be changed in a way that removes rights already acquired by a consumer where doing so would be contrary to Australian Consumer Law.

Refunds and Consumer Rights

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

Where a patient is entitled to a refund or other remedy under Australian Consumer Law, these Terms & Conditions do not affect that entitlement.

Social Media Promotions

Where a promotion is advertised through Facebook, Instagram or another third-party platform, the promotion is conducted by Live Strong Physiotherapy unless expressly stated otherwise.

Unless specifically stated, the relevant social-media platform does not sponsor, endorse, administer or have any association with the promotion.

Any additional conditions contained in the relevant promotional post or advertisement also apply.

Fair Use

Promotions are intended for genuine patients accessing Live Strong’s services.

Live Strong may refuse or cancel a promotional redemption where there is reasonable evidence of fraud, misuse, duplicate redemption or an attempt to circumvent the stated conditions of the promotion.

Privacy

Personal information collected in connection with a promotion will be handled in accordance with Live Strong Physiotherapy’s Privacy Policy and applicable privacy legislation.

Information collected for the purpose of providing healthcare will be handled in accordance with our normal patient privacy and record-keeping obligations.

Participation in a promotion does not automatically require a patient to consent to receiving ongoing marketing communications.

Australian Consumer Law and Applicable Law

These Terms & Conditions are subject to the Australian Consumer Law and any other applicable Commonwealth and Queensland legislation.

These Terms & Conditions are governed by the laws applicable in Queensland, Australia.
